Felonies vs. Misdemeanors

Felony offenses are those that can have a profound impact on every aspect of your life. The consequences of a felony conviction on your record could have adverse effects on your current and future employment, higher education, military service, school loans and grants, public assistance, driver’s license privileges, right to vote, right to carry weapons/firearms, and many other aspects of your life. In general, the maximum penalties for felony offenses are as follows:

  • Third-degree felony - 5 years in prison, 5 years of probation, and/or a $5,000 fine
  • Second-degree felony - 15 years in prison, 15 years of probation, and/or a $10,000 fine
  • First-degree felony - 30 years in prison, 30 years of probation, and/or a $10,000 fine
  • Life felony - life in prison and/or a $15,000 fine
  • Capital felony - death penalty

Misdemeanor offenses have less severe penalties than felonies. However, they can have just as severe consequences with regard to future education, driving privileges, and employment, if you are adjudicated guilty. For example, possession of cannabis under 20 grams, racing on highways, and petty theft are all misdemeanors but carry potential license revocations of 2 years, 1 year, and 6 months respectively. In addition, first-degree misdemeanors are punishable by up to 1 year in county jail, 1 year on probation, and a $1,000 fine. Second-degree misdemeanors are punishable by up to 60 days in jail, 6 months on probation, and a $500 fine. In addition to those, there are hybrid second-degree misdemeanors like reckless driving offenses that are punishable by up to 90 days in county jail. First-time driving under the influence offenses are second-degree misdemeanors with enhanced penalties.

Inchoate crimes can be defined as those that are "incomplete" crimes. When individuals are inclined to act toward a certain criminal goal (and fail to do so) or participate in an indirect fashion, then the crimes of attempt, conspiracy, and solicitation can be charged.

Statutes on inchoate crimes provide that individuals may be held criminally responsible for the intent to commit a crime, even if the crime is not actually committed. Inchoate crimes require that an individual have the intent to commit the criminal act and that they take some step to achieve the goal. Attempt, conspiracy, and solicitation are all inchoate crimes.
